HelloTap Terms of Service
Esta página está disponible solo en inglés por ahora.
Effective date: {EFFECTIVE DATE}
HelloTap is a product of AG47 Ventures LLC ("HelloTap," "we," "us").
These Terms are an agreement between you and AG47 Ventures LLC. They cover your use of hellotap.app, HelloTap cards, the card assistant, the receptionist, and everything else we offer (the "Service"). Please read them carefully. Our Privacy Policy explains how we handle your information.
1. Accepting these Terms
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
If you use HelloTap for a business, you're agreeing to these Terms for that business, and you confirm you have authority to do so. "You" then means both you and the business.
2. Who can use HelloTap
You must be at least 18 years old to create an account. By signing up, you confirm that you are. You can't use HelloTap if we've previously suspended or banned your account, or if the law doesn't allow you to.
3. Your account and signing in
- You can sign in with an email and password, an emailed sign-in link, or your Google account. We may add other sign-in options later. When you sign in through Google or another provider, their terms also apply.
- Give us accurate information and keep it up to date.
- Keep your password and sign-in links private. You're responsible for everything that happens in your account.
- Tell us right away at support@hellotap.app if you think someone has gotten into your account.
- Teams. If you add people to your team, you're responsible for their use of your account. Your team's account owner can manage team cards, see their leads, contacts, and stats, and remove team members.
4. Plans and prices
| Plan | Monthly | Yearly |
|---|---|---|
| Free | $0 | $0 |
| Plus (1 user) | $5 per month | $50 per year |
| Pro | $15 per month | $150 per year |
| Extra users (Pro only) | $5 per month for each extra user | $50 per year for each extra user |
Prices are in U.S. dollars. Plus is for 1 user. On Pro you can add extra users, up to 20 users in total. You can choose monthly or yearly billing for Plus and Pro. What each plan includes is shown on our pricing page. We may change prices or plan features. If we raise the price of your paid plan or an add-on, we'll email you at least 30 days in advance. The new price applies from your next renewal after that notice. To avoid it, cancel before that renewal.
5. Free trials, automatic renewal, and canceling
Please read this section carefully. It explains how you'll be charged.
- Free trial. Plus and Pro start with a 30-day free trial. You need to add a payment card to start it. You pay nothing for the plan when you start the trial, but you pay at checkout for any tap cards you order. Each team can use one free trial. If you sign up with a promotional code, the trial length and price shown at checkout apply instead. For example, a Founders Club code gives Pro free for 90 days, then 50% off Pro for as long as you stay subscribed.
- Your trial turns into a paid subscription. At the end of your free trial, your subscription starts automatically and we charge your card the price of your plan for the billing period you chose, unless you cancel before the trial ends. Monthly: $5 per month for Plus, or $15 per month for Pro plus $5 per month for each extra user. Yearly: $50 per year for Plus, or $150 per year for Pro plus $50 per year for each extra user. Checkout shows the amount and date of your first charge.
- Your subscription renews automatically until you cancel. A monthly plan renews every month, and a yearly plan renews every year. We'll charge the same card at the start of each new month or year, counted from the day your paid subscription started, until you cancel. There's no minimum term beyond the period you've paid for.
- How to cancel. You can cancel anytime online in Billing (Stripe customer portal). Go to Billing in HelloTap, open the Stripe customer portal, and choose to cancel. You can also update your card and download invoices there. If you need help, email support@hellotap.app.
- What happens when you cancel. Canceling stops future charges. You keep your paid plan until the end of the period you've already paid for, then your account moves to the Free plan. This works the same for monthly and yearly plans. No partial refunds for the rest of that period. If you cancel during your free trial, you won't be charged. You don't lose your account, but paid features stop when it moves to Free. (If you dispute a payment, different rules apply. See Section 8.)
- Failed payments. If a payment fails, you have 5 days to update your card. If it isn't fixed by then, your account moves to Free.
By starting a trial, a paid plan, or an add-on, you authorize us, through Stripe, to charge your payment card as described above.
6. Refunds
Subscription and add-on payments are non-refundable, and we don't give refunds for partial billing periods. You can cancel or remove an add-on anytime to stop future charges. If you move to a plan that already includes an add-on you pay for, we credit the add-on's unused time on your next bill. That credit isn't a refund and can't be paid out in cash. If we refund a subscription payment in full, your subscription ends and your account moves to the Free plan. If you think we charged you by mistake, email support@hellotap.app. This section doesn't limit any refund rights you have under the law.
Token packs have their own rules in Section 7. If we shut down the Service, Section 16 applies.
7. AI Card Designer and token packs
- Tokens. The AI Card Designer uses tokens. Every new team gets about 500,000 starter tokens one time, when it signs up. Free has no monthly tokens. Plus includes 1.8 million tokens a month, and Pro includes 3.6 million tokens a month. Monthly tokens reset on the 1st of each month (UTC) and don't roll over.
- Token packs. On Plus or Pro, you can buy extra tokens in one-time packs: $5 for 1.2 million tokens, $10 for 2.4 million, or $20 for 4.8 million. A pack is not a subscription and doesn't renew.
- If your account moves to Free, your pack tokens are paused: we keep them, but you can't use them until you're back on Plus or Pro. Pausing doesn't extend the expiry date.
- Pack tokens expire 12 months after you buy them. Tokens you haven't used by then are lost.
- We use your monthly plan tokens first, then any one-time starter tokens, then your pack tokens, starting with the pack that expires soonest.
- Tokens work only in the AI Card Designer. They have no cash value and can't be transferred or sold.
- All token and pack purchases are final and non-refundable, except where the law requires a refund.
- If we refund a pack payment, we remove that pack's tokens in proportion to the amount refunded. Your balance never goes below zero.
- If you dispute a pack payment with your bank or card issuer, we remove all of that pack's unused tokens. They're removed for good, even if the dispute is decided in our favor. Tokens you've already spent aren't affected.
- For billing problems, contact us first and we'll help. Email support@hellotap.app.
8. Payment disputes and chargebacks on subscriptions
If you have a problem with a charge, please contact us first at support@hellotap.app. We'll work with you to fix it.
If you dispute a subscription payment with your bank or card issuer, we cancel your subscription right away (not at the end of the billing period) and may suspend your account. That can include unpublishing your cards and blocking new sign-ups that use the same email, sign-in account, or payment details. We keep your account data while it's suspended; suspension doesn't delete it. If your account is suspended, contact us at support@hellotap.app. Once the dispute is resolved, we may restore the account at our discretion.
Referral rewards tied to a payment that's refunded or disputed are reversed.
9. Your content
"Your content" means everything you add to HelloTap, such as your card details, photos, logos, reviews, services, prices, service areas, leads, contacts, and notes.
- You own your content. We don't claim ownership of it.
- You give us permission to use it to run the Service. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, display, and share your content only as needed to operate and provide the Service to you. That includes showing your public cards to anyone with the link, using your card's information to answer your visitors, and sending your content to our service providers (for example, to our AI providers when you use the AI Card Designer). This license ends when your content is deleted, except for copies we must keep under our Privacy Policy or the law.
- Your card is public. Photos and logos on your card are stored at public web addresses, even if the card is unlisted or password-locked. Don't put anything on your card you don't want people to see.
- You're responsible for your content. You must own it or have the rights and permissions needed to use it, including permission from people shown in your photos.
Leads, contacts, and messages you send
When people send their details through your card or your card assistant, they agree that your business may contact them by phone, text, or email about their request. You're responsible for how you contact your leads and contacts, and for following the laws that apply, including laws on calls, texts, email marketing, and privacy. Only contact them about what they asked for unless they've given you other consent the law requires. Review requests you send from HelloTap open in your own email or text app and are sent by you, not by us.
Card assistant, receptionist, and bookings
- Card assistant. Your card can show an automated AI assistant that answers visitors' questions from your card's own information, such as your services, prices, service area, and hours. It tells visitors it's an automated AI assistant and that prices are ballpark until you confirm them. It can be shown in English or Spanish.
- Keep your information accurate. The assistant and receptionist only know what you give them. You're responsible for keeping your services, prices, service area, and hours up to date, and for the quotes and appointments you give your customers.
- Not for emergencies. The assistant and receptionist can't dispatch anyone. They tell people to call you directly for anything urgent.
10. Acceptable use
Don't use HelloTap to:
- Break the law or help someone else break it.
- Post content that's false or misleading, including fake reviews, licenses, or insurance details.
- Pretend to be someone else or a business you don't represent.
- Post content you don't have the rights to, or that violates someone's privacy or other rights.
- Post content that's hateful, harassing, threatening, sexually explicit, or that exploits minors.
- Send spam, or contact people without the consent the law requires.
- Spread malware, phishing, or scams.
- Interfere with the Service, get around our limits or security, or access accounts or data that aren't yours.
- Scrape, copy, or resell the Service without our written permission.
We may remove content or suspend or close accounts that break these rules.
11. Text messages (SMS)
HelloTap sends text alerts to card owners. Businesses that use HelloTap may also text the visitors who contact them.
- Card alerts for owners. If you turn on text alerts, HelloTap will text the phone number you give us when your card is viewed, a link is tapped, or you get a lead.
- Texts to visitors. If you send your details through a HelloTap card, its assistant, or its receptionist, the business may text you about your own request. Those texts come from that business, not from HelloTap, and the business is responsible for them. To stop them, reply STOP to the business or contact the business.
- Consent isn't a condition of purchase. You don't have to agree to receive texts to buy or use anything.
- Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.
- To stop HelloTap texts, reply STOP to any message, or turn off text alerts in your settings. For help, reply HELP or email support@hellotap.app. Replying STOP also turns off text alerts. If you reply START, you'll need to turn alerts back on in your settings.
- Carriers aren't responsible for delayed or undelivered messages.
- Only give us a phone number that you're allowed to use.
- We don't sell or share your mobile number or text opt-in with third parties for marketing. See our Privacy Policy.
12. AI-generated content
The AI Card Designer uses an AI provider to suggest text and design changes. Your card assistant and receptionist also give automated answers. AI output can be wrong, incomplete, or similar to content others get. Review everything the AI suggests before you use it, and make sure it's accurate and that you're comfortable publishing it. You're responsible for what you put on your card, including AI-generated content. Don't rely on AI output for legal, licensing, insurance, or other professional claims.
13. Plans, downgrades, and features
Free accounts can use the features shown for the Free plan on our pricing page. When an account moves to Free, paid features stop working, but your account and content stay.
14. Referral program
If you take part in our referral program, the referral terms shown in your dashboard also apply.
If you sign up with a referral discount, you can't change your plan or number of users during the free trial. You can still cancel anytime.
15. Third-party services
HelloTap works with services run by other companies, such as Stripe for payments, Google and Apple for sign-in, Cloudflare for spam protection, Twilio for text messages, and AI providers for the AI Card Designer, card assistant, and receptionist. Your use of those services may be covered by their own terms and privacy policies. We aren't responsible for third-party services or websites, including sites your card links to.
16. Ending your account
- You can stop using HelloTap anytime. To stop paying, cancel your subscription in Billing (Stripe customer portal) (Section 5). To have your account deleted, email us at support@hellotap.app.
- We can suspend or close your account if you break these Terms, dispute a payment (Sections 7 and 8), create risk or legal exposure for us or others, or if the law requires it. We'll try to tell you first unless we can't, or doing so would cause harm.
- We may change or stop offering parts of the Service. If we shut down the whole Service, we'll email you at least 30 days in advance, so you have a chance to export or save your card information. If you've prepaid for subscription time you haven't used when we shut down, we'll refund that unused part pro rata.
- Sections that by their nature should continue after your account ends will continue, including Sections 7, 8, 9 (for content we must keep), and 17 through 21.
17. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't promise that the Service will always be available, error-free, or secure, that your messages, bookings, and alerts will always be answered or delivered, or that you'll get any particular number of leads or customers.
18. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- WE AREN'T LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, even if we were told they might happen.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR (B) $100.
Some places don't allow these limits, so they may not all apply to you.
19. Indemnity
If someone makes a claim against us because of your content, your use of the Service, how you contact your leads and contacts, or your breaking these Terms or the law, you agree to cover our reasonable losses and costs, including reasonable attorneys' fees. We'll tell you about the claim and let you help with the defense.
20. Resolving disputes
- Talk to us first. If you have a problem with HelloTap, email us at support@hellotap.app with a description of the issue and what you'd like us to do. We'll try to resolve it informally. You and we agree to give each other 30 days to try to work it out before starting a court case.
- Where to bring a claim. If we can't resolve it, either of us may bring a claim in small claims court if it qualifies, or otherwise in the state or federal courts located in San Diego County, California. You and we agree to those courts' jurisdiction.
- Governing law. California law governs these Terms, without regard to its conflict-of-law rules.
21. General terms
- Changes to these Terms. We may update these Terms. We'll change the effective date at the top. If we make a material change, we'll tell you by email or with a notice in the Service at least 15 days before it takes effect. Other changes take effect when we post them, with the updated effective date. If you keep using HelloTap after a change takes effect, you accept the new Terms. If you don't agree, stop using the Service and cancel your subscription.
- Entire agreement. These Terms, our Privacy Policy, and any terms shown when you buy something (like the token pack terms at checkout or the add-on terms in Billing) are the whole agreement between you and us about the Service.
- If part of these Terms can't be enforced, the rest still applies.
- If we don't enforce a term right away, we can still enforce it later.
- Transfer. You can't transfer these Terms without our permission. We may transfer them if HelloTap is sold, merged, or reorganized.
- Notices. We may send you notices by email or in the Service.
